Terms & Conditions

Payment Terms

1.   Deposit & Payment: Non-Refundable $100 Deposit Due at time of booking. A Deposit confirms the date.

Final balance is due 7 Days prior to the event.

2.   Delivery Charge: Delivery is included within 15 miles of the offices of The Backdrop and Flower Wall Company in Baltimore, MD or Dewey Beach, DE (seasonally). Delivery outside that radius will incur an additional fee.

3.   Rush Fee: For bookings within 7 days of an event, a rush fee will be added. 5-7 days from the day of the event an additional 25% surcharge will be added to the invoice, 2-4 days 50% surcharge will be added, within 48 hours an 80% surcharge will added to the total cost of the invoice.

​

Any additional charges incurred by scheduling delays, or damages on behalf of the renter, their venue, or guests are due within 7 business days days following the event. An invoice will be sent detailing any additional charges 

​

Specialty requests and custom backdrops require additional terms.

4. Delays and Damages: Any additional charges incurred by scheduling delays, or damages on behalf of the client, venue, contracting party, and/or guests are due within 7 day(s) following the event.

Scheduling

5. Event Details: Event set-up and breakdown times will be confirmed 10 day(s) prior to the scheduled event. If details are changed or schedules are delayed for any reason by the client, contracting party, and/or venue within 10 day(s) of the scheduled event date, rental is subject to availability and there is a $30 charge for every 15 minute(s) delay to set up or pick up.

Deposits are non-refundable.

Rescheduling is subject to availability and additional fees

6. Set Up & Breakdown Times: Creative props & backdrops take at least 1.5 hour(s) to set-up. This does not include unloading time and .5 hour(s) to breakdown. Additional time may be needed for custom requests and specialty items.

Please allow ample time for venue access and schedule accordingly. Jacqueline Pearlstone LLC/DBA The Backdrop and Flower Wall Company and/or anyone acting on behalf of the company, cannot guarantee proper set up, creative execution, or product quality standards if insufficient time is given to properly set up or pick up rental items.

Jacqueline Pearlstone LLC/DBA The Backdrop and Flower Wall Company and/or anyone acting on behalf of the company is not liable if unable to deliver to the contract or customer specifications due to scheduling delays caused by the client, contracting party, and/or venue's inability to provide minimum recommended allotted time for set-up and breakdown.

Should set up be extended or delayed due to the elements (wind, rain, etc), unforeseen circumstances, or incorrect or misrepresented information by the client, contracting party and/or venue Jacqueline Pearlstone LLC/DBA The Backdrop and Flower Wall Company and/or anyone acting on behalf of the company is not liable if unable to deliver to the contract or customer specifications.

7. Parking

The client, venue, or contracting party is responsible for providing parking and providing reasonable accommodation to load and unload.

​

Insurance & Damage

8.   Excessive Damage: Rental prices are inclusive of insurance for damage (or misplacement) of equipment or materials up to a certain value ($50). Excessive Damages or misplacement of valuable items will be billed to the contracting party at the market rate within 10 business days of the event. Payment is required within 10day(s) of receiving invoice.

 9. Custom and Specialty Requests: For custom props, backdrops, and specialty requests, a pre-agreed deposit will be required to cover materials, labor, recklessness, vandalism, neglect, or if an item is misplaced. If an item is misplaced, breaks or requires repair a fee for the market value will be deducted from the deposit

Creative Prop Policy

10. Prop Placement: Jacqueline Pearlstone LLC/DBA The Backdrop and Flower Wall Company and/or anyone acting on behalf of the company has final approval on all prop & backdrop placement.

Items need to be placed on even and flat surfaces. It is recommended placement near a wall for stability & protection against the wind.

Should set up be extended, cancelled, or delayed due to the elements (wind, rain, etc), uneven ground, unforeseen circumstances, or incorrect or misrepresented information by the client, contracting party and/or venue no refund will issued and Jacqueline Pearlstone LLC/DBA The Backdrop and Flower Wall Company and/or anyone acting on behalf of the company is not liable if unable to delivery to the customer or contract specifications.

If additional time and/or resources are required for any of the reasons mentioned, services are subject to availability and/or additional fees; results are not guaranteed.

Outdoor Use Policy

11. Outdoor Set Up Fee: There is an additional fee for outdoor set-up's. Advanced noticed is required

12. Inclement Weather Policy: Backdrops, props, balloons, materials and any services or products provided by Jacqueline Pearlstone LLC/DBA The Backdrop and Flower Wall Company and/or anyone acting on behalf of the company are for indoor and outdoor use, unless otherwise stated. They are not made for inclement weather. If outdoor use is preferred, equipment must be taken down and moved indoors or undercover overnight. If bad weather or wind become an issue, Jacqueline Pearlstone LLC/DBA The Backdrop and Flower Wall Company and/or anyone acting on behalf of the company has ultimate authority to deny outdoor placement for safety reasons. Jacqueline Pearlstone LLC/DBA The Backdrop and Flower Wall Company AND/OR ANYONE ACTING ON BEHALF OF THE COMPANY IS NOT RESPONSIBLE SHOULD SERVICES NOT BE RENDERED DUE TO UNFAVORABLE CONDITIONS, UNFORSEEN CIRCUMSTANCES, INCORRECT OR MISREPRESNETED INFORMATION AND/OR PROPS BECOME UNUSABLE AFTER SET UP.

Balloons

13. Balloon Hazards & Allergies: Balloons are hazardous to children and there is a risk of chocking. Do not leave children unsupervised around setup. Latex allergies must be declared before booking

​

14. Set Up & Care: Client gives permission to use command hooks on any interior wall or adhesive hooks on exterior walls and understand risk of damage.

​

15. Balloon Care: Balloons will last 1-2 days at best outdoors. Do not put balloons near direct sunlight, by a radiator or in a car/shed overnight Balloons are delicate– please avoid letting children play/sharp objects near the setup Heat/Cold affect the lifespan of the balloons Once the balloons are in the client’s possession, they are your responsibility.

Miscellaneous

16. Force Majeure: Jacqueline Pearlstone LLC/DBA The Backdrop and Flower Wall Company and/or any acting on the company's behalf shall be excused from any delay or failure in performance required hereunder if caused by reason of any occurrence or contingency beyond its reasonable control, including, but not limited to, acts of God, acts of war, fire, insurrection, strikes, lock-outs or other serious labor disputes, riots, earthquakes, floods, explosions or other acts of nature.

17. Limited Liability: The Client, vendor and/or contracting company acknowledges and agrees that Jacqueline Pearlstone LLC/DBA The Backdrop and Flower Wall Company and/or anyone acting on behalf of the company not be liable for any losses or damages, whether indirect, incidental, special or consequential, in profits, goods or services, irrespective of whether or not the Client has been advised or otherwise might have anticipated the possibility of such loss or damage.

18. No Guarantee: The client, venue, and/or contracting party acknowledges and agrees that and/or Jacqueline Pearlstone LLC/DBA The Backdrop and Flower Wall Company and/or anyone acting on behalf of the company cannot guarantee the results or effectiveness of any of the services rendered or to be rendered. Rather, services shall be executed in a professional manner and in accordance with good industry practice. Best efforts will be used but no results are promised.
